A new report also identifies collaborative divorce as a way to help people across Ontario.
Earlier this summer, The Law Commission of Ontario released its final report in its family law project, Increasing Access to Family Justice through Comprehensive Entry Points and Inclusivity.
The report explores some of the major issues facing family law in Ontario and recommends ways to address them. It lists collaborative divorce as a way people in Ontario avoid using the courts while evading adversarial problems, time delays and other issues.
The report stated:
“Many collaborative clients are of modest means, looking for a way to ensure they do not end up accumulating significant debt or eating up any retirement savings in a legal battle in or outside court…There are not studies to our knowledge that conclude a collaborative approach is more expensive than traditional adversarial negotiations.”
The LCO’s Final Report focuses on the initial stages of the family law system, notably the provision of information, ways of providing initial advice and the interrelationship of legal problems with other kinds of problems.
