Health Care Benefits

Can a husband take his wife off of his health care coverage when they are separated (but not yet divorced)? They are both teachers, and both have their own coverage. Their date of (financial) separation has already passed. Thank you.

Answer

It depends on what the court order or separation agreement says you can do. Sometimes there is an obligation to keep the other on their benefits but if there is no obligation to pay spousal support, there may be no such obligation. In the absence of an agreement or court order, you can do whatever you wish to do.
