Step-Parent Adoption

Step-parent adoption offers families a meaningful opportunity to strengthen bonds and provide children with a secure, supportive environment.

By formalizing the relationship between a step-parent and child, this process ensures legal recognition and stability, benefiting both the child and the family as a whole.

Process summary 

Consent requirements

The court typically requires consent from the child’s other biological parent, unless that parent is absent or their involvement is detrimental. The child’s best interests are paramount, and their views may be considered, especially if the child is age 7 or older. Written consent is often required for children aged 12 and above.

Application Filing

The step-parent must submit an adoption application to the court, including Form 34H: Affidavit of Adopting Relative or Stepparent5.

Supporting Documents

Required documentation includes the child’s birth certificate, proof of marriage or common-law relationship, and any existing custody or access orders6.

Dispensing with Consent

If the other parent’s consent cannot be obtained, the court may consider a motion to dispense with consent7.

Court Review

Upon approval, the court updates the child’s birth registration to reflect the new legal parent8.

Child support

Once adoption is finalized, the biological parent whose rights are terminated is no longer responsible for child support.
