Our Proven Family Law Process
Guiding You Every Step of the Way
At Galbraith Family Law, we have developed a proven process that ensures our clients receive the highest level of service and support throughout their family law matters. Our approach combines expert legal knowledge, personalized attention, and effective communication to help clients move toward practical solutions and positive outcomes.
Whether you are dealing with separation, parenting issues, support, property division, or divorce, our team will guide you through each stage of the process with clarity and confidence.
Step 1: Initial Consultation
Every family law matter begins with a conversation.
During your initial consultation, we take the time to understand your circumstances, concerns, and goals. We answer your questions, explain your legal options, and provide tailored advice based on your unique situation.
By the end of the consultation, you will have a clearer understanding of your rights, responsibilities, and the next steps available to you.
Step 2: Financial Disclosure
Family law requires both parties to exchange financial information, including details about income, assets, and debts.
This disclosure process ensures that informed decisions can be made regarding support and property matters. We help our clients gather and organize the necessary information while ensuring all legal requirements are met.
We also learn more about family dynamics and parenting arrangements to identify practical solutions for child-related issues.
Step 3: Negotiations
In most family law matters, negotiation plays an important role in reaching a resolution.
Our lawyers develop strategic approaches to help protect your interests while working toward fair and practical outcomes. We assist with:
- Preparing settlement offers
- Reviewing and evaluating proposals
- Advising on negotiation strategies
- Exploring options that align with your goals
Negotiations may take place through correspondence, meetings, mediation, or collaborative discussions.
Step 4: Settlement or Court Order
Many family law matters are resolved through mutual agreement.
Once an agreement has been reached, the terms are documented in a Separation Agreement, creating a legally binding arrangement between the parties.
If issues cannot be resolved through negotiation, the court may become involved. A judge can make a Court Order that establishes a legally binding decision that both parties must follow.
Our team will guide you through either process and ensure your interests are represented every step of the way.
Step 5: Divorce
For married spouses, the final step may involve obtaining a Divorce Order, which legally ends the marriage.
Our team prepares and submits the necessary court documents and guides clients through the process until the Divorce Order is granted.
If you and your former partner were in a common-law relationship and were never legally married, a divorce is not required
